Varig drift
Det er vilkår at virksomheten drives varig. Det er id en forbindelse tilstrekkelig at det, ut fra virksomhetens formål, anses sannsynlig at virksomheten drives aktivt i mist 3 år fremover. Åpenbart kortvarig drift faller saledes utenfor bestemmelsen.
Vilkåret er ikke oppfylt. Vi viser at det ikke er fremlagt en nøyaktig beskrivelse av virksomhetens art, dokumentasjon på det økonomiske grunnlaget for driften, i form av finansierings og budsjettplaner.
Selskapsform
Bestemmelsen i utlendingsforskriften § 6-18 gjelder selvstendig næringsdrivende. Det er ikke krav om en konkret selskapsform, men utlendingen skal ha en sentral, selvstendig og ledende rolle i driften. jf. Arbeids – og inkluderingsdepartementets rundskriv om ikrafttredelse av ny utlendingslov og ny utlendingsforskrift fra 1. januar 2010 (A-2009-063). Hvis virksomheten er etablert som aksesjeleskap, og utlendingen i tillegg til å være aksjoner også skal delta aktivt i driften, skal søknaden vurderes i forhold til utlendingsforskriften 6-1 første ledd. Det samme gjelder dersom utlendingen skal drive/delta i driften av et norskregistrert utenlandsk foretak (NUF). I alle andre tilfeller vil det bero på en konkret individuell vurdering om den respektive selskapsformen, og søkerens deltakelse i driften, er i samsvar med bestemmelsens formål.
Loven regulerer ikke hvor omfattende utlendingens arbeid/aktivitet skal være, men det følger av fast forvaltningspraksis at det også for selvstendig næringsdrivende skal ligge på det nivået som tilsvarer en heltidsstilling for ansatte. Når det dreier seg om et enkeltpersonforetak legges det til grunn at dette vilkåret er oppfylt. For lavere aktivitetsgrad enn heltid må det vurderes individuelt om vilkåret om aktiv deltakelse likevel er oppfylt.
