Søknaden er vurdert spesielt etter bestemmelsen son gjelder oppholdstillatelse til selvstendige næringsdrivende utlendingsloven § 25. jf. Utlendingsforskriften § 6-18 første ledd.
Selvstendig næringsdrivende som skal drive varig næringsvirksomhet har rett til oppholdstillatelse dersom det er nødvendig for etablering eller videre drift av virksomheten at den næringsdrivende oppholder seg i Norge og deltar aktivt i driften.
Det er vilkår at
a. Det arbeidet som skal utføres i virksomheten, krever at den selvstendig næringsdrivende har kompetanse som faglært, og det foreligger godkjenning eller autorisasjon fra relevant fagmyndighet i yrker hvor det er kvalifikasjonskrav i lov eller forskrift, og

b. Det godtgjøres at det er økonomisk grunnlag for driften og

c. Det foreligger tillatelse for virksomheten i henhold til øvrig lovgivning

Dette følger av utlendingsforskriften § 6-18 første ledd. Retningslinjer er gitt i UDIs rundskriv RS 2014-009 “Oppholdstillatelse til selvstendig næringsdrivende».
