Økonomisk grunnlag/underhold
Det er vilkår for en oppholdstillatelse at underhold er sikret, jf. utlendingsloven § 58.
Underholdskravet er 82 prosent av lønnstrinn 19 i Statens lønnsregulativ, som fra 1. mai 2015 tilsvarer 235.258, - kr per år.
Ved tillatelse som selvstendig næringsdrivende er det forutsetning at underhold i det vesentlige vil være sikret gjennom ervervsvirksomheten, jf. utlendingsforskriften § 10-7 tredje ledd.
Det må godtgjøres at det er økonomisk grunnlag for driften jf. utlendingsforskriften § 6-18.
Uttalelse om det økonomiske grunnlaget for driften skal innhentes fra den aktuelle fylkeskommunen og om nødvendig fra en bransje- eller yrkesorganisasjon jf. Utlendingsforskriften § 6-18 annet ledd.
Vilkårene er ikke oppfylt. Det vises til at det ikke er fremlagt en nøyaktig beskrivelse av virksomhetens art, dokumentasjon på det økonomiske grunnlaget for driften i form av finansierings og budsjettplaner. Søknaden er således ikke forelagt Fylkeskommune for uttalelse.
For at søkeren skal få oppholdstillatelse, må underhold være sikret, jf. utlendingsloven § 58.
UDI anser underhold for å være sikret når søkeren fyller kravene i utlendingsforskriften § 10-7 første ledd bokstav a til d, eller ved kombinasjon av disse. Dette følger av § 10-7 første og annet ledd.
Dette vilkåret er ikke oppfylt. Det vises til at det ikke er fremlagt en nøyaktig beskrivelse av virksomhetens art, dokumentasjon på det økonomiske grunnlaget for driften, i form av finansierings og budsjettplaner.
Utlendingsdirektoratet har vurdert om personen er vernet mot utsendelse etter utlendingsloven § 73.

There are conditions for a residence permit that subsistence is ensured, cf. The Immigration Act § 58.
The subsistence requirement is 82 percent of salary grade 19 in the national salary scheme, as from 1 May 2015 corresponds to 235.258, - per year.
By permission as an independent trader is the prerequisite that subsistence essentially will be ensured through the activities, cf.. Immigration Regulations § 10-7 third paragraph.
It must be demonstrated that there is an economic basis for the operation cf. the Immigration Regulations § 6-18.
Report on the economic basis of the operation shall be obtained from the relevant county and, if necessary, from a trade or professional organization cf. the Immigration Regulations § 6-18, second paragraph.
The conditions are not met. It appears that it is not lodged an accurate description of the nature, evidence of the economic basis of the operation in terms of funding and budget plans. The application is thus not submitted to County Council for comment.
For the applicant to obtain a residence permit, must subsistence be ensured, cf.. Immigration Act § 58.
UDI considers entertaining to be ensured when the applicant meets the requirements of the Immigration Regulations § 10-7 first paragraph letter a to d or by combination thereof. This follows from § 10-7 subsections.

Immigration has considered whether the person is protected against refoulement under the Immigration Act § 73.
